HOUSE ADOPTS MOTION ON IMPEACHMENT OF H.E WILLIAM ODUOL, THE DEPUTY GOVERNOR, SIAYA COUNTY

The House, has today 29th May, 2023, during a Special Sitting, adopted a Motion sponsored by Hon. Gordon Onyango Onguuru, MCA, East Asembo Ward, seeking to remove the Deputy Governor – H.E William Oduol, from office, by way of impeachment.
The Motion is in line with Article 181(1) of the Constitution of Kenya, 2010 read together with Sections 33 (1) and 33 (9A) of the County Governments Act, 2012.
The House resolved to impeach the Deputy Governor from the attendant docket on the grounds of;
- Gross violation of the Constitution of Kenya, 2010; the County Governments Act, 2012; the Leadership and Integrity Act, 2012; Public Procurement and Asset Disposal Act, 2015; Anti-Corruption and Economic Crime Crimes Act, 2016; County Assemblies Powers and Privileges Act, 2017 and the Public Officers Ethics Act, 2009
- Abuse of office; and,
- Gross misconduct
Among other things, the Deputy Governor is accused of interference with the county procurement processes through acts of bid-rigging. The Deputy Governor is accused of unjustifiably relying on the authority of his office to cause changes in certain specifications in eighty six tender documents for roads construction through coercion. He is also accused of interfering with the procurement of supply and delivery of certified seeds and fertilizer.
The Deputy Governor is further accused of banking on the authority of his office to force the incurring of expenses of approximately Ksh. 18 million for purposes of renovating his office; an expenditure that was not in the budget and therefore not in the procurement plan.
Consequently, in line with the provisions of Standing Order 71 read together with Standing Order 72 of the County Assembly of Siaya Standing Orders, the County Assembly has appointed a Special Committee comprising of a third of its Members to investigate the grounds upon which the impeachment motion is hinged on.
The Special Committee comprises of the following Members:-

- Fredrick Omoro, MCA
- Cynthia Akinyi, MCA
- Dorothy Oinga, MCA
- Eunice Ndolo, MCA
- John Apodo, MCA
- Julie Okello, MCA
- Justus Oguta, MCA
- Michael Otieno, MCA
- Oliver Arika, MCA
- Seth Ochieng Baraka, MCA
- Sylas Madingu, MCA
The Special Committee shall report, within ten (10) days, to the County Assembly, on whether it finds the particulars of the allegations against the Deputy Governor to have been substantiated.
The Deputy Governor has the right to appear and be represented before the Special Committee during its investigations.
No further proceedings shall be taken on the matter if the Special Committee finds the allegations unsubstantiated.
If the Special Committee reports that it finds the allegations substantiated, the Assembly shall vote whether to approve the resolution to impeach the Deputy Governor.
