COUNTY ASSEMBLY QUESTIONS LEGALITY OF FORMER ACTING FINANCE CECM’S CONTINUED ROLE

The County Assembly of Siaya has passed a far-reaching motion accusing former acting County Executive Committee Member (CECM) for Finance and Economic Planning, Mr. George Nying’iro, of unlawfully performing functions of the finance docket despite lacking lawful authority after the expiry of his contract.
The motion, moved by Hon. Dorothy Oinga, throws the spotlight on what Members of the County Assembly (MCAs) termed a possible constitutional and administrative crisis within the county’s finance department at a critical budget-making period.
The motion states that once Mr. Nyingiro’s acting contract expired on 31st March, 2026, and after his nomination for appointment as CECM for Finance and Economic Planning was rejected by the County Assembly on 29th April, 2026, he ceased to hold any lawful authority to conduct transactions on behalf of the county in the finance docket.
MCAs noted that Mr. Nying’iro had initially served in the acting capacity due to his position as the substantive CECM for Roads, Public Works, Housing and Urban Development. This position has since been filled following the appointment of a new CECM by the Governor on 13th May, 2026.
In the motion, the Assembly accused the County Executive of allegedly continuing to entertain Mr. Nying’iro in the finance office contrary to provisions of the Constitution, the County Governments Act, 2012 and the Public Appointments (County Assemblies Approval) Act, 2017, which require vetting and approval by the Assembly for anyone to lawfully hold office as a County Executive Committee Member.
The Assembly also referenced Mr. Nying’iro’s testimony during his vetting by the Appointments Committee, where he disclosed under oath, that his contract had been extended; however, he could not provide a letter confirming this extension – a document the Assembly is not privy to.
Consequently, the House has directed the County Executive to immediately stop allowing any unauthorized officer to undertake the functions of the CEC Member for Finance and Economic Planning.
Additionally, the House resolved to investigate any role Mr. Nying’iro may have played in county financial transactions from 1st April, 2026, with a view to taking further appropriate actions.
Furthermore, the Assembly resolved to formally notify the Office of the Controller of Budget, Central Bank of Kenya and other financial institutions dealing with the County Government of Siaya that, since the expiration of Mr. George Nyingiro’s contract on 31st March, 2026, there has been no authorized person to transact on behalf of County Government of Siaya.
MCAs further warned that should investigations reveal that Mr. Nying’iro continued acting as the Finance Executive after the expiration of his contract, the Assembly would publish a public notice national newspapers declaring that he is not authorized to conduct transactions on behalf of the County Government.

The House also resolved that the appointing authority would bear full responsibility for any acts of omission, irregularities, illegalities, or administrative consequences arising from the absence of a substantive Finance Executive.
